A Rochester woman convicted in the death of her 3-year-old son will get a new trial.
A state appellate court threw out Andrea Lipton's 2022 manslaughter conviction, saying statements she made to police shouldn't have been used at trial.
Prosecutors say she didn't get help for her son, after her boyfriend, Anthony Love, assaulted him at an Avenue C apartment in July 2020.
Lipton was serving a 7-and-a-half-year sentence.
Love is serving 25 years for his 1st-degree manslaughter conviction.
