Rochester police have an arrest in a shooting back in September outside a deli on Plymouth Avenue.
26-year-old David Binion was arrested and charged with assault and criminal possession of a weapon.
Additional charges are pending.
Police say Binion shot a 28-year-old store employee after he tried to stop Binion from creating a disturbance inside the store.
The dispute spilled out into the parking lot, where Binion shot the victim before running away.
Police and US Marshals spotted Binion in a car on Arch Street.
Binion refused to stop but was finally halted by tire deflation strips on Genesee Street.
Binion is now being held in the Monroe County Jail.
