UPDATE:A Bangladeshi national has been identified as the person killed in last week's tour bus crash.
38-year-old Tofazzal Hossain was critically injured when the bus overturned on 490 near the Chili exit Thursday morning.
Hossain died the next day at the hospital.
The Sheriff's Office is still investigating to determine whether more charges will be filed.
The driver was orignally given four tickets following the crash.

28 people are in area hospitals, after a tour bus overturned on 490 this morning.
It happened near the Chili Exit in the westbound lanes shortly after 7.
One of the victims is in critical condition.
Sheriff Todd Baxter says the scene was chaotic.
Authorities are still working to reconnect victims with their families, and have set up a hotline at 585-753-4455.
The bus was heading from New York City to Niagara Falls, and had just made a dropoff in the area.
The crash remains under investigation.
