The sentence is 20 years to life in prison for a Rochester man for a fatal shooting outside a restaurant on East Ridge Road.
Forty-nine-year-old Shawn Appleberry was convicted of second-degree murder and a gun crime back in November.
Prosecutors say he gunned down 42-year-old Desmond Diggs, following an argument, outside Tangie’s Kitchen in March 2022.
Appleberry's sentencing had been on hold since February, amid allegations of juror misconduct.
