An 81-year-old Batavia man is under arrest for allegedly shooting at a Genesee County sheriff's deputy.
It happened early yesterday morning at Gregory Poole's home on Lewiston Road in Batavia.
The deputy had gone there for a report of a burglary.
The sheriff's office says Poole was outside and opened fire after the deputy identified himself.
The deputy returned fire, then took cover and waited for backup.
Poole was finally arrested and charged with reckless endangerment and menacing an officer.
Poole suffered minor injuries in a struggle with the burglar, but no one was hit by the gunfire.
