The state's highest court,the Court of Appeals, has refused to hear the appeal by the James Krauseneck family to review the Brighton ax murder trial.
Krauseneck was convicted and sentenced to prison last year, and died this spring while his appeal was pending.
As required by state law, a lower court vacated his conviction earlier this month. But the family wanted the court to review the trial to demonstrate his conviction was invalid and clear his name.
Krauseneck was tried for the 1982 murder of his wife Cathleen at their home.
