Appeals Court Rejects Appeal in Brighton Whole Foods Case

A mid-level state appeals court has rejected an appeal by opponents of the Brighton Whole Foods Store to force the operation to downsize.

The Appellate Division of State Supreme Court threw out the appeal by the group Save Monroe Avenue and several town residents today.

They contended the Town of Brighton broke the law by allowing private development to encroach on part of a walking trail without holding a public vote.

The lower court ruled that the town never dedicated the two-mile stretch of trail as park land or maintained it.

The appeals court unanimously agreed.
