Group Attempts to Stop the Opening of a Brighton Whole Foods Store

A mid-level state appeals court will hold a hearing late this afternoon on a group's last-ditch request to stop the Whole Foods store from opening in Brighton.

Brighton Grass Roots has appealed last week's State Supreme Court ruling -- which threw out its lawsuit claiming the plaza would obstruct a public trail. Brighton Grass Roots also asked for a restraining order to prevent the store from opening.

Whole Foods is due to hold its grand opening at 7:00 tomorrow morning. The Appellate Division's hearing on the request for a restraining order is at 4:00 this afternoon -- just 15 hours before the store is supposed to open.
