Assembly Speaker Carl Heastie says the impeachment investigation into Gov. Andrew Cuomo will be suspended...although the Republican minority and a number of Democrats were in favor of continuing.
They wanted the governor impeached to remove the possibility that he might run for state office again some day.
But Speaker Heastie says he's consulted with senior lawmakers of the Assembly Judiciary Comittee and with lawyers. He says first, the governor's resignation ends the question of whether Governor Cuomo should remain in office. Second, he says the state constitution doesn't authorize the legislature to impeach an elected official who's no longer in office.
Heastie says the Assembly Judiciary Committee will turn all its evidence relating to the governor's incidents of sexual misconduct, his handling of the State Nursing Homes during COVID-19 and the issues concerning Cuomo's memoir over to the five District Attorneys who are investigating Cuomo for potential criminal violations.
