State Senate Passes Nursing Home Liability Shield Repeal

The State Legislature has voted to repeal the law shielding nursing homes and hospitals from malpractice lawsuits stemming from the pandemic.

The bill would reverse a provision last year in the state budget bill that granted immunity to health providers from negligence suits brought by coronavirus patients.

The Assembly has already passed the repeal, and the Senate passed it Wednesday.

The bill now goes to the Governor's desk.

The immunity provision had the backing of the hospital lobby, which opposes the repeal.
