The family of the 9-year-old girl pepper-sprayed by Rochester Police is suing the city and the RPD.
The notice of claim was filed this morning.
It alleges the officers inflicted emotional and physical distress on the girl.
The officers involved are also accused of using excessive force.
One officer is suspended and two others are on leave, pending an internal review.
