A court order says the City of Rochester must turn over all materials relating to the death of Daniel Prude to attorneys representing his family in a civil suit against the city.
The order was filed this week. It says the city failed to provide all the materials sought in a Freedom of Information Law request, filed when Prude's family sued the city back in September. The order cites a 300-page report from the Deputy Mayor as evidence the city didn't perform a "diligent search" for all the materials the lawyers asked for.
The order says Deputy Mayor Jim Smith's 323 pages of supporting documents demonstrate that the city lacked a reasonable basis to deny the petitioner's request for "all other records containing factual data relating to the incident," and for "any other handwritten notes related to the incident. The order also reads that none of the communications or other records requested by the Prude family are protected communications.
