Federal prosecutors are arguing against a motion by Charlie Tan to have his 20-year prison sentence thrown out.
His motion claims he had ineffective help from his lawyers and the findings of a mental health evaluation should have mitigated his sentence for federal gun charges.
But prosecutors say there is no new information about Tan's mental health, and his admission that he killed his father deserved the full sentence.
Tan admitted in his motion that he killed his father at their home in Pittsford in 2015.
