Prosecutors Cause Delay By Withholding Evidence

Lawyers for developer Robert Morgan say federal prosecutors have dragged their feet supplying the defense with evidence that will be presented at Morgan's pending fraud trial.

That claim is the basis for a defense motion for dismissal of the indictment.

A hearing on the motion is set for this spring. Morgan's trial is set for early next year.

According to the D&C, the evidence at issue is data from Morgan's computers, and federal authorities will likely say there have been problems translating it for the defense.

Morgan is accused of providing false information about his properties to mortgage lenders.
