A federal grand jury has indicted a Farmington man on charges of failing to inspect a building for presence of asbestos, plus failure to remove, store and dispose of it properly.
James Marshall was a Maintenance Supervisor with the Finger Lakes Office for People With Developmental Disabilities. His job included cleaning out buildings intended for renovation or demolition. Just over five years ago, he certified a state-owned building in Newark was asbestos-free before it was cleaned out. But after the job was certified complete, asbestos was found in the building in a condition that was polluting the air and put the workers at risk.
He's accused of violating the Clean Air Act and negligent endangerment.
