Special Prosecutor Chosen For Assemblyman's DWI Case

Yates County District Attorney Todd Casella has been chosen to be the special prosecutor for the Brian Kolb DWI case in Ontario County.

Kolb is the state Assembly minority leader and was arrested after he crashed his state-issued SUV in Victor New Year's Eve.

Ontario County District Attorney Jim Ritts said Wednesday that Kolb had a blood alcohol level above .08 after he crashed.

At least one of Kolb's fellow Republicans in the Assembly has publicly called for him to step down as minority leader.
