Astacio's Request To Vacate Sentences Denied

A judge has rejected former judge Leticia Astacio's request to vacate her previous sentences on DWI probation violations.

Astacio said she deliberately violated her probation again so she could get a court date, because she believes her original DWI sentence is illegal. The judge denied her motions.

The latest charges this fall involve misuse of her car interlock device and failure to report to probation. She is due back in court November 26.

Earlier this year Astacio was acquitted of a felony charge alleging she violated her DWI probation by trying to buy a shotgun.

Astacio was removed as a Rochester City judge last fall and has been working as an attorney.
