A 16-year-old in Rochester is accused of raping an 11-year-old. The teen is charged with first-degree rape and being held in secure juvenile facility. Under the Raise the Age law the age of criminal responsibility is 18-years-old. Previously, New York was one of only two states that automatically prosecuted 16 and 17-year-olds as adults.. A judge will determine the defendant's status at a later date.
