Stenographer's Audio Recording Causes Delay in Prosecution

The prosecution of another case in Batavia is being challenged over the conduct of a court stenographer.

The attorney for assault defendant Antwan Odom asked for a hearing yesterday because the stenographer made an audio recording of the grand jury proceedings.

The attorney wants to see the minutes of the proceedings to determine whether the recording was prejudicial to Odom.

The stenographer testified she was never told making recordings is against the law. She says she used the recording to double check her own notes.

At least two other high-profile cases in Batavia were challenged because of the recordings, but were allowed to go forward.
