A judge has granted the Rochester school district and school board an injunction blocking the planned referendum on a state takeover of the city schools.
In the 17-page ruling, Justice Scott Odirisi said the City's proposals for remedying the great challenges in the school district "are admirable, but not legally permissible."
He says state law does not allow purely advisory referendums. And he ruled Mayor Warren was wrong to use city resources for a letter to voters endorsing the referendum.
The judge also rejected the City's argument that the board and the district did not have legal standing to sue.
