Man Charged In Connection with Drug Overdose Death Will Remain Behind Bars

A judge has changed his mind and now won't release a man accused of tampering with evidence after his girlfriend died of an overdose. 

Judge Chris Ciaccio had said Friday that Scott Pernesky could be released before his trial and would not have to post bail -- but would have to wear an ankle monitor. Gates police and prosecutors objected, citing Pernesky's felony record and past escapes in Colorado. Ciaccio ruled today Pernesky should remain in jail without bail. 

Pernesky's girlfriend Jennifer Baker died of a heroin overdose in February at the Motel 6 in Gates. Investigators say he hid the drugs that were still in the room and wrapped Baker's body in sheets before fleeing.
