A state appeals court has reversed a Rochester man's murder conviction. Preston Carter was convicted in the 2008 death of Joel Greenberg. The victim was found in a blood-spattered hotel room in Henrietta. His skull had been fractured. The appeals court says there was evidence to show that Carter could have committed the crime, but not enough to PROVE that he did.The judges found that Carter was in the victim's hotel room , but so were other people. Carter is expected to be released from prison and return home to Rochester. He had been sentenced to 25-years to life.
