Charlie Tan, the Pittsford man whose murder trial ended in a hung jury, will not be re-tried for murder.
An appellate court delivered that ruling today.
Tan was charged with killing his father inside their Pittsford home in February of 2015 and a mistrial was declared in October, after the jury couldn't come to a decision after 8 days of deliberation.
Then in November, Judge James Piampiano shocked everyone involved dismissing the case citing lack of evidence to support a murder charge.
In their ruling, the appellate court judges said Piampiano erred in dismissing the indictment saying that the evidence was legally sufficient to support the charge----but the judges determined that there was no statutory authority to reverse the ruling and allow for another trial.
