Prosecutors in the George Moses case will be allowed to present evidence that Moses used taxpayer funds to support a girlfriend living in Canada.
Moses's lawyers argued unsuccessfully that the testimony about an extra-marital affair could prejudice the jury at Moses' upcoming trial.
Moses allegedly wrote off trips to Canada as part of his job as head of a taxpayer-funded nonprofit.
He's also accused of defrauding a subsidiary of the Rochester Housing Authority while serving as the RHA chairman.
The trial is currently set for October.
