Man Charged In 1982 Ax Murder Case Wants It Dismissed

Lawyers for the man charged in the Brighton ax murder case want the case dismissed.

James Krauseneck is scheduled to go on trial this year for the 1982 killing of his wife Cathy.

At issue are efforts by investigators -- years after the homicide -- to narrow the time of death to the hours when Krauseneck was home with his wife.

His lawer, Michael Wolford, spoke after a court date yesterday.

Prosecutor Bill Gargan says there is a new twist in the timeline that would undermine the defense claim that James Krauseneck was at work when his wife was killed.

Another hearing is scheduled for June.
