Legislator Wants More Info on Fatal Crashes In Which Driver Not to Blame

Monroe County Legislator Rachel Barnhart wants police to release the names of drivers who are NOT charged in deadly crashes.

Pedestrian Roderick Cunningham was struck and killed on a street in Barnhart's neighborhood on November 16. Police said the driver was not facing charges and did not name that person. Barnhart says that silence prompted rumors that police were shielding the driver.

She claims the public interest in transparency in a death investigation outweighs a driver’s right to privacy.

The police report on the crash was obtained by 13 WHAM. It identifies the driver as 41-year-old Richard Augsbury. He passed a field sobriety test and had not been speeding. He told police another car's headlights caused a glare on his windshield, during which he hit Cunningham.
