Astacio Motions Denied in Court

Former Rochester City Court judge Leticia Astacio was back in court today...where a judge declined her request to vacate her previous sentences on probation violations.

Astacio appeared in court last month to face allegations she violated her DWI probation for misusing her car interlock device and for failure to report to probation. She had told the judge she violated her probation so she could get a court date -- because she believes her original DWI sentence is illegal. She argued in four separate motions that the previous sentences were illegal because proper procedures weren't followed. The judge denied all four motions.

She's due back in court on November 26th.

Earlier this year Astacio was acquitted of a felony charge alleging she violated her DWI probation by trying to buy a shotgun.

Astacio was removed as a Rochester City judge last fall. She lost a primary for a City Council seat in June, and has been working as an attorney.
