Former Assemblyman May Not Be Able to Assist in Own Defense

There's some doubt whether former state Assemblyman Joe Errigo is fit to stand trial on federal bribery charges.

The 81-year-old Errigo was in court Wednesday. He had clearly lost weight and attorney Joe Damelio asked for a hearing on what the judge called "serious health issues." Damelio says he plans to submit evidence that shows his client is not able to assist with his defense.

Errigo was accused last year of accepting a bribe to introduce legislation benefiting a developer. If he cannot assist in his own defense, the case could be dismissed.
