City Appeals Court Ruling That Blocked Referendum

The City of Rochester has formally filed its legal brief with the Appellate Division of State Supreme Court, appealing last week's court decision that blocked a referendum on state takeover of the city schools.

Rochester Mayor Lovely Warren strongly backs the advisory referendum, hoping it will convince the State Education Department to step in and remove the City School Board from control of the schools. But the trial judge said such advisory votes are not allowed by the New York State Constitution.

The school district says it is evaluating the city's arguments and waiting for notification from the Appellate Division on when the case will be argued. The district says they are confident in the merits of their case.
