NYS: Pending Legislation Could Lower Legal Blood Alcohol Level for Driving

Legislation pending in the state Assembly could lower the threshold for someone to be considered drunk behind the wheel.

The bill would lower the legal blood alcohol level for driving from .08 to .05. And the bill would lower the level required for a more serious Aggravated DWI charge from .18 to .12.

Supporters say the tougher restrictions could reduce crashes and save lives.

But critics say the legislation could hurt the economy. They argue two glasses of wine with dinner at a restaurant could put someone over the limit.
