MCSO: Inmate Mistakenly Released Following Court Appearance

A review is underway after an inmate in the custody of the Monroe County Sheriff's Office was inadvertently released following a court appearance today.

The sheriff's office says 30-year-old Elvin Medina-Bauza walked out of court after a judge dismissed a case against him. But it was later determined that he should have remained in custody on burglary and menacing charges related to another case. 

Rochester Police arrested Medina-Bauza within 30 minutes of his exit from court, and sent him to the Monroe County Jail. 

Sheriff Todd Baxter says the error should not have occurred and the case will be thoroughly reviewed by the Internal Affairs Department and the NYS Commission of Corrections.
