Local Developer Going to Court Over Proposed Trash to Energy Incinerator

Rochester developer Circular enerG is going to court to fight a ruling threatening its plans for a waste-to-energy incinerator at the former Seneca Army Depot in Romulus.

The Zoning Appeals Board voted to reverse a prior finding that the incinerator would be a renewable energy source. The new court filing claims the appeals board vote was conducted illegally -- without a quorum, with a member who had a conflict, after a deadline for appeals, and based on incorrect information. 

Cicular enerG wants the original finding about the incinerator to be reinstated, and wants the board blocked from making further rulings on the project.
