UPDATE: Rochester police say the shooting of a man found dead at a home on Emerson Street appears to be a justifiable homicide.
Police say the victim was 22-year-old Zhymar Thacker, who along with another man forced his way into the house at about 5:25 Sunday morning.
Thacker was found at the top of a stairwell to the second floor, dead of multiple gunshots.
A second man who lived in the home was shot in the torso and taken to the hospital.
He has since been released.
Police say that man was sleeping upstairs with family members, most of them children, when they heard the rear door being kicked in.
The homeowner armed himself and exchanged shots with Thacker when he reached the top of the stairs.
Both guns were recovered.
Neither of them was registered.
The incident remains under investigation.

Rochester police continue to investigate the city's latest homicide.
They say someone gunned down a man in his 20s early yesterday morning at a home on Emerson Street, near Edgerton Park.
A second man was hit in the leg, and is expected to recover.
Police say 8 people were inside the home at the time, ranging from 7 months to 18 years old.
No one has been arrested, and anyone with information should call 911.
