The state Attorney General's Office says it won't file criminal charges against a state trooper who used deadly force.
Trooper Dominic Caito shot and killed Daniel Legler, of Chili, last year.
Legler refused to pull over for a traffic stop, resulting in a chase that ended when Legler crashed near Rochester Tech Park in Gates.
During a struggle, Trooper Caito heard gunfire, saw Legler holding a gun, then shot him.
The Attorney General’s Office concluded a prosecutor would not be able to prove the shooting was not justified.
