The wrongful death lawsuit brought by the estate of Daniel Prude against the City of Rochester has ended in a $12 million payout.
Mayor Evans says in a statement that the settlement was the best decision for the City, given the costs of continued litigation.
Prude died in 2020, days after he became unconscious while being restrained by Rochester police.
The medical examiner said his death was caused by “complications of asphyxia in the setting of physical restraint" and secondary causes were “excited delirium” and acute intoxication from PCP.
$4 million from the settlement will go to the lawyers representing the Prude estate.
