UPDATE: Judge Issues Stay, Keeps Mask Mandate in Effect

New York state's mask mandate is back in effect.

A judge granted a stay in the case while the appeal is litigated.

A state appellate court held a hearing on the matter this afternoon, after a state Supreme Court judge overturned an indoor mask mandate.

Governor Hochul said she still supported the wearing of masks.

ORIGINAL STORY:

A judge has ruled that Governor Hochul's mask mandate can't be enforced.

The State Supreme Court judge on Long Island says the state health department doesn't have the legal authority to enforce the mandate.

He ruled Monday the law must be approved by the state legislature, otherwise it's void and unenforceable.

Governor Hochul says the state will appeal.

She had ordered in December that businesses without mandatory vaccination policies must require that all workers and customers wear masks to prevent the spread of COVID.
