Ontario County District Attorney Jim Ritts has named Yates County DA Todd Casella as a special prosecutor to handle Assemblyman Brian Kolb's DWI Case.
Ritts wants to make sure there is no appearance of impropriety.
Kolb was arrested after he crashed his state-issued SUV into a ditch on New Years' Eve at his address on County Road 41 in Victor. Kolb is apologizing for his arrest.
The arrest came just days after Kolb -- a Republican -- made a public statement urging people not to drink and drive.
