Rochester Mayor Lovely Warren has lost another court fight in her attempt to put a state takeover of the city schools on the November election ballot.
An appeals court has upheld a lower court opinion that the referendum would be illegal.
The referendum would not have been binding, but Warren had hoped strong voter support would persuade the state legislature to approve a state takeover.
