An Ontario County grand jury has determined that the police shooting of an off-duty parole officer in Canandaigua last fall was justified and no criminal charges will be filed.
District Attorney Jim Ritts says Sandy Guardiola fired first, before Sergeant Scott Kadien fired the three shots that killed her.
Kadien had gone to the woman's apartment at the Pinnacle North complex to check on her welfare. Ritts says there is no indication Guardiola was suicidal. He says Kadien had given verbal commands to Guardiola to put her gun down before he fired at her.
Ritts says it appears Kadien followed Canandaigua police policy.
