Monroe County's industrial development agency has voted to revoke developer Scott Congel's tax abatement deal on the Medley Centre Mall -- if he doesn't make the full payments owed to local governments by May 1st.


County Executive Maggie Brooks went to the COMIDA board with that request and another for COMIDA to join the county in any possible legal action against Congel. Both requests were approved. Brooks took the rare move of speaking at the COMIDA board meeting, something she hasn't done for 10 years.


She says Congel has now missed two payments on his Payment In Lieu Of Taxes agreement and three "milestone" deadlines when he was supposed to have invested specific amounts of money into redeveloping the empty mall.


COMIDA's attorney says he expects this is all headed for State Supreme Court on May 2nd.
